POLICIES AND PROCEDURES RELATED TO THE CONFIDENTIALITY OF PERSONAL INFORMATION

Applied Digital, Inc. (ADI) is aware of the various issues related to the disclosure of personal information on the Internet. ADI will respect at all times your right to confidentiality when you visit its Internet sites and use its services to send messages, shop, perform various transactions, or to inform or entertain you. You will find below the main policies and procedures which ADI agrees to abide by with regard to the confidentiality of personal information. CHANGES IN POLICIES AND PROCEDURES

Since Internet-related technologies are constantly changing, these policies and procedures related to the confidentiality of personal information are subject to change at any time. Any change will be posted on this page. PERSONAL INFORMATION COLLECTED

Prior to accessing some of its Internet sites, ADI will ask you to fill in a form on which you must provide certain information. Also, to personalize your services, ADI may ask you to fill in a form on the screen and provide personal information such as your sex, age, education, etc. Finally, ADI may sometimes ask you to fill in other forms with additional personal information for contests, surveys and special offers in which you may want to participate.

OBJECTIVE OF THE COLLECTION OF INFORMATION

The personal information requested by ADI is solely intended to offer you services, content, tools or advertising which correspond to the preferences you have informed us about by way of the various forms, so you can derive the most benefit from your visits to our Internet sites.

E-mail Addresses — With users’ e-mail addresses, ADI can regularly send interested users promotional information concerning services offered by ADI or its advertisers. You can still register on the form even if you do not wish to receive promotional information from ADI. Also, ADI can contact you by using your e-mail address about your statement of account, changes to your subscription agreement or to confirm your registration.

The “Email this Article” function is a simple way for ADI to e-mail articles you find interesting to your friends. The e-mail address you provide will not be used for any other purpose. ADI will not send any unsolicited e-mails. We use e-mail links in our Contact Us page to allow you to contact us directly for any questions or comments you may have. With your e-mail address, we can respond to you directly about your questions or comments.

The Use of “Cookies” — ADI uses “cookies” in order to recognize users and provide them with personalized services for which they have registered and also to monitor their visits to the site. ADI also uses anonymous “cookies” for the purpose of evaluating the traffic at its sites and setting fees for its advertising space. In this way, advertisers know how many users have visited one of our sites and for how long so they can measure the actual or likely impact of their advertising on our sites. IP Addresses — ADI registers IP addresses or the location of your computer on the Internet for purposes of system administration and troubleshooting. It should be noted that we do not use the registration of IP addresses to monitor your session or your behavior on our sites.

CONSENT

When ADI asks you for personal information, you are always given either an express or an implied notice. You are also informed that the information will be processed, i.e. the processing related to the collection, registration, preparation, change, storage or destruction of said personal information. You always have the choice of refusing this request or stopping a subscription to a personalized service that you may have previously chosen.

LIMITATION OF THE COLLECTION OF INFORMATION

ADI only collects personal information required to meet the objective for which said personal information is collected.

LIMITATION OF USE, DISCLOSURE AND STORAGE

Use — ADI only uses personal information for the purposes for which a user has given his or her consent, unless its use has been authorized by law (see in this regard the section dealing with Legal Compliance).

Disclosure Without your express prior consent — The personal information collected by ADI remains strictly intended for its use and is not accessible to any of its customers, partners, advertisers or other outside parties, subject to the Statistical Analyses and Targeted Advertising and Legal Compliance sections. In addition, we will not disclose any personal information about you as an individual to a third party, subject to the circumstances described in the Legal Compliance section.

LEGAL COMPLIANCE

ADI may disclose personal information about a user if we are legally required to do so, or if we believe, in good faith, that such a disclosure is necessary to 1. comply with any law or regulation in force or a legal proceeding; 2. protect and defend our rights and interests or those of our users; 3. prevent any unauthorized use of ADI’s Internet sites; or 4. protect the personal security or the interests of our users or the public in general.

STORAGE OF INFORMATION

ADI only stores personal information for a period which is reasonably necessary to meet the purposes for which it was collected. Then, we erase or make anonymous any personal information which is no longer required for a specific purpose.

To prevent any unauthorized access, maintain the accuracy of information and ensure the appropriate use of information, we have implemented the appropriate physical, electronic and administrative procedures to protect all personal information collected on line.
